I doubt he got in any kind trouble for that.  Only Novices and Techs are restricted to slopbucket in that segment.  AM is perfectly legal for Generals and higher.
But a lot of misinformed hams would argue that it's illegal to operate AM in that segment, just like they will argue that the bandwidth of AM is legally limited to 6 kHz.
