Just call them (Yaesu) and tell them what the problem is and the
circumstances and see what they say about coverage under warranty. Trying
to "force" them to do it under warranty is not likely to result in the
result you seek. Threatening them with what "you" think the law is not
likely to create a relationship that will be productive either. Getting a
lawyer to study it and/or sue the company or to force them to do the repair
is likely to be MUCH more expensive than just sending it in and paying for
it if that is the way it works out. If the radio is worth fixing, fix it,
pay for it and enjoy it, else, throw it away or sell it for parts. Did you
buy it "broken" or did it "break" after you had it? if it was "broken" when
you bought it and the seller claimed it was totally functional, and
depending on the integrity of the person you bought it from, talk to them
about at least sharing the cost of the repair.

One more thing, since I am not a lawyer, it would again, be beneficial to
research your options and to fully understand that not all warranties are
restricted to what the manufacturer tells you. Most manufacturers will not
volunteer what they are obligated to do, but if you remind them, then that
may work harder.

There are Warranties of Fitness that apply in the USA. People do have
protection under the law. Even if "they" state that "they" do not cover
implied nor expressly stated, they still are likely to have an obligation,
under US law. They are CERTAINLY Warranties of Fitness for a particular
use. The radio should work for a reasonable amount of time as long as you
do not abuse it. The key is, clearly understanding what is reasonable.
