[Wswss] 2-Meter FM Repeater on 144.090 MHz? On ebay

While looking around on ebay for a few misc. parts for a few Repeater projects, I ran into the following item today (ebay Item # 300104271291 ) which is a crossband 6 to 2-Meter Repeater, listed by KF6OWC in Taylorsville, CA. The 2-Meter portion is on 144.090 MHz FM simplex with a CTCSS tone. 

It was my understanding that CW ONLY was permitted between 144.000 and 144.100 MHz, according to my recent ARRL Amateur Bands chart. Did I miss something?

Here's the text from the auction listing: 

"Motorola Micor (VHF Low) and A GE (VHF High) cross band repeater.  It is currently set up for a local 6 meter FM repeater and a couple of 6 meter FM simplex frequency, 52.525 and 52.04.  This unit is capable of 100 watts on six meters.  The VHF high side is crystal for 144.09 fm with a pl tone to keep from being interfered with.  It is about 1/2 watt on 2 meters.  It is all housed in side a NEMA 3R box, the box has Knock outs on the bottom for power and the antenna feed line.  this unit was working when it was taken out of service as part of a trade.  The approx. dims are 18"WX24"HX10"D.  Shipping will probably run around 80 dollars.  I will be a Emmcomwest in reno in may, no shipping if you are there, Insurance extra. Looking up KF6OWC on QRZ.com returns a listing with a rather disjointed, somewhat incoherent "biography".  

Maybe the guys in California that might have had some FM interference while trying to do weak signal work now know where it might have come from. I wonder which lucky ebay bidder will put it up on the air next at its new home...
