Great suggestion...and, incidentally, one of my favorite topics.
I think the problem with nearly all of the "codified PRB-1" measures that
have passed in many states is that there is no teeth to the PRB measure.
No definition of "reasonable accommodation". What this really means is that
while it might be possible to defend unreasonable/unlawful zoning
restrictions doing so will usually require that the unfortunate ham hire an
attorney to defend PRB-1. What this can, potentially, mean is a small
fortune in attorney fees...sometimes much in excess of the cost of the
actual tower.
I would much rather see a minimum height allowance of, say, 70 feet for
properties of less than a 1/2 acre. Increase that limit to 100 feet for 1/2
to 3 acre properties and unlimited (subject to FCC/FAA restrictions) for
properties over 3 acres.
Please realize that I'm just pulling some numbers out of the air but it's a
place to start. I get so frustrated every time I hear of someone who cannot
install a tower over some ridiculously low height of 25 feet. The
municipality deems this "reasonable".
I think the biggest problem we have in Wisconsin though is apathy.
