it's my feeling that a law officer is not trained in the feild of 
electronics and rf, and is not trained enough to distinguish between a HF 
ham tx and a pirate AM transmitter. or between a pirate AM or FM Transmitter 
and a Part 15 AM or FM Transmitter.
Under Part 15.219 a Part 15 AM Transmitter can Reach up to 3miles solid. Now 
along comes mr engineer from xyz radio. the operator is getting 2-3miles he 
must be pirate. He whines to the FCC, they come out and inspect and find 
nothing wrong. not the result he want's so he presures the locals to come at 
you and all they have is your word and the word of a engineer. or what if he 
bypasses FCC entirely and just goes to the local DA. You have no recourse. 
and then there are the legal interpretations. under part 15.219 you are 
allowed 100mw input to final RF stage, is that modulated or unmodulated, 
what about the 3 meter total length on antenna, feedline and ground, is the 
pole the tranny is mounted on included in the 10 ft limit or not. are kits 
and homebuilt transmitters legal or are they not. these are questions an FCC 
agent can answer, but can the local DA or Police Officer distinguish the 
difference.

Ok put it another way you homebuilt a ham transceiver, you like 
homebuilding, they get interference complaints unsubstantiated and the 
police come out and see your antenna farm. oh he must be a pirate. they come 
in and see all your homebrew equipment. are they able to tell the difference 
between ham gear and a pirate transmitter? unless the cop is a ham i don't 
think so.

these are just questions that come to mind.

there are tons of scenarios that make this a bad law.
