[TVARC] Maximum flagpole height?

Hi Members of TVARC’s MailList (especially those interested in flagpole antennas in The Villages),

Don’s (W1EJM) response correctly answered John’s (AE5X) question about the maximum height of a flagpole.  Don’s response quoted the applicable Florida law, which allows flagpoles up to 20 foot high regardless of what covenants or restrictions maybe in the homeowner’s association (HOA).

However, DO NOT ignore the last part of that applicable statute.  It only overrides HOAs if the flagpole does not obstruct sight lines at intersections and is not erected within or upon an easement.  Since most of us have no idea where the crazy easements run on our properties in The Villages, you MUST file an application with The Villages “Architectural Review Committee” (ARC) to  insure your proposed flagpole does not run afoul of easements you probably aren’t even aware of. 

In my case, I was shocked by the 30 foot easement from the road onto my property (in case the county/State ever wants to turn my side street into a highway!).  Luckily, I submitted the ARC’s application for my flagpole and they initially denied it because my proposed location was about 3 foot inside this existing easement.  So, in my case, it was a simple matter of moving the proposed location about 3 foot closer to the house.  Then, the ARC approved my application.

Of course, there are lots of other reasons to “follow the rules” and submit the ARC application for your flagpole.
