You won't get arrested for simply having a system key in your
possession.

Software to generate system keys. If Moto knows you have this and can
build a case against you, you're off to court.

No, but once you transmit on that system, even if it's just simple
communications with the controller, it can be seen as interference
with public safety communication.

There are no specific laws but in a court of law with Motorola, you'll
soon find out how other laws can be applied. Motorola doesn't care
about Joe Normal who has programmed his/her own radio for their
listening pleasure. They go after software distributors and those who
sell their programming services. The Larry(?) Gass case for example.

If Motorola wants you bad enough, they'll find a legal way. Otherwise,
there are no specific possession laws for the above mentioned items.
Something may fall under the Digital Millennium Copyright act but I'm
not familiar with it.
