This presupposes that the people in question (patent people) are 
rational and honest and competent.  Those are pretty steep assumptions, 
unfortunately.

Consider the patents that Monsanto has currently secured for genetic 
material that has been around for probably tens or even hundreds of 
millions of years.  What logic went into that decision?  It probably 
looked a lot like George Washington, many many times replicated.
