I'm not a lawyer but it seems to me that if someone has a fireplace 
(gas or wood), they have "assumed the risks" involved with fireplaces 
including chilrens touching them. If you present them with a waiver you 
are acknowledging that you have some liability to be waived.

If you do have liability risk I don't think that having a waiver signed 
will really release you from liability. I think the only liability you 
could possibly have would be if you were somehow negligent in your 
design or construction such as sharp edges etc.
