[TheForge] picket spacing

I was in a new hotel last month. I will never figure out how they got
away with the railings.
Four foot high made of horizontal 2 inch piping, about 12 inch spacing,
going up four stories around an atrium.
At one point I counted four kids in different locations standing on the
second to the top rail waving to each other or parents across the expanse.
The rails suited the style of the building , but , Can anyone say lawsuit?
