When I checked with the building department of the entity that had
jurisdiction over the house that I was installing a gate in, they said that
under the Uniform Building Code, you do not have to abide by the 4" rule if
the ground under it DOES NOT CHANGE LEVEL from one side to the other. I
would check with the building department of the jurisdiction in which you
are putting it to be sure that they use the same code.
And the 4" rule is that a 4" ball can not pass through the rail or gate at
any point so it must be slightly less than 4".
