hello;
i received a couple e-mails asking me why i am down on the insurance
industry and insurance agents/brokers. instead of replying to them
individually i figure i would post my answer to theforge and at the same
time provide a brief update to the old-timers.
the insurance industry, in my opinion, is at best a scam forced upon the
general public by the same banks and government which profit from the
insurance industry.
as many of the old-timers of theforge know i was involved in a work
related accident on 26 nov 1996. the left arm and shoulder were trashed.
numerous surgeries later the left arm and shoulder are still going down
hill. the workman's compensation insurance carrier responsible to cover
the accident was placed in rehabilation 1 april 2002 by the insurance
commissioner of the commonwealth of pennsylvania.
legion insurance of pennsylvania, villanova insurance of pennsylvania,
and legion indemnity of illinois were/are held by a holding company.
that holding company is/was 100 percent owned by mutual risk management
of bermuda. on 9 april 2003, legion indemnity of illinois, was placed in
liquidation under the office of special receiver for the state of
illinois. mutual risk management of bermuda, is either under bankruptcy
in the usa and/or a scheme of arrangement under british law, or both.
legion insurance of pennsylvania and villanova insurance of
pennsylvania, have been placed in liquidation by several states,
north carolina, california, and texas, independent of the
commonwealth of pennsylvania courts..
since 1 april 2002, legion insurance, has repeated obtained
from commonwealth of pennsylvania courts, stays of litigation. the
illinois industrial commission and the illinois courts are honoring
those stays of litigation under 'comity'.
even before being placed in rehabilaiton legion insurance of
pennsylvania was not paying the medical bills which resulted from the
26y nov 1996 accident. those medical providers are now demanding that i
pay those bills.
the way the illinois workman's compensation law is writing along with
the attitude of the illinois courts prohibits my suing the consulting
company that i was working for at the time of the accident. my lawyers
and i are currently weighing the possibility of going to federal court.
you are probably asking 'what does all this mean?'
legion insurance of pennsylvania, per a settlement aggreement reached
before they were placed rehabilation, owes me in excess of $700,000.00
usd plus interest and penalities. will i ever see that money, probably
not. my lawyers have all ready told me; "terry, you have been hung out
to dry."
how does all this relate to elbows? well, after the numerous surgeries
the doctors stated perhaps we should have done this or that. my comment
to them was basically; "why have one surgery when you can have two for
twice the cost. ( i was/am being sarcastic. ) if at all possible avoid
surgery on the shoulder, elbow, and/or wrist. no matter what anyone says
the joint is never really the same after that.
