Hello Ron,
If there is an oil gap when the load is vertical, only the link between the 
input connector and the hot end of the resistor may be in air - not a huge 
hazard.
I suggest that you open a Bird Termaline, because I don't think you have.

operating the resistor partly not submerged (overheating that portion
of the resistor) and the air rising from the hot fins will not be able
