The second amendment refers to "A well regulated Militia, being necessary to the security of a free State".

That's what the army, and other military departments, do.
That doesn't give you the right to shoot a prospective trespasser or burglar who, whilst a threat to you, is certainly 
not a threat to your "free state".

I would respectfully suggest that many Americans mis-interpret the constitution so as to support their opinion.
