[SJDXA] Ham tower case decided by US District Court

The information below was in a recent FOC newsletter about the Tower fight that Tom K5RC has been going through, it was finally decided by a US District Court in Tom’s favor.  The basic story is that Tom obtained the necessary permits 4 years ago to erect 8 towers on his 10 acre property.  During construction some of the neighbors complained to the officials about the permits being granted and they officials attempted to rescind all permits. 

“K5RC - Four years ago, Tom and the W7RN crew were in the midst of a big antenna project on Tom’s 10-acre homestead outside of Virginia
City NV. He had obtained a building permit for two rotating monopoles. The bases had been installed, and there were other existing antenna
structures on the property. The County issued a Stop Work Order on grounds that were never clear. The US District Court would later write:
“The court is sympathetic to Plaintiff’s frustration with the county’s inconsistent interpretation of its zoning ordinances.” Today, after two
trips to the U.S. District Court, the case is closed. K5RC may erect eight towers: four less than 45’ tall, and four greater than 45’ tall. The
complete list, including heights, of permitted antenna support structures may be found at Section 15 of the conditions, page 8 of the
Stipulation of Dismissal. The Stipulation is a matter of public record, and construction may resume. June 29, 2012. The full text at:”
