What in the world does a law on the books in Evansville have to do with IC-35-44-3-12 Illegal use of a Police Scanner,Eating Hamburgers on Sunday???Im am so sorry but this has nothing to do with a Police Scanner in a car,If you are a Ham Radio Operator by STATE LAW you are covered and exempt, but on the other hand if you are not a Ham Radio Operator and you get stopped by a Law Enforcement Officer and he does see the radio ,by state law if you do not have the proper paper work or a letter signed by the Chief Law Enforcement Officer in the county you live in, you are in violation of 35-44-3-12,This is the reason why I carry a copy of the Burns Statute 35-44-3-12 with me in my car at "all Times",For everyones infomation a couple of months ago, we had a "Ham Radio Operator" Stopped in Indianapolis by a officer with Indianapolis Police Department on the east side of Indianapolis beacuse the officer walked up to his car after he stopped the car , he told the person that he had a Illegal Police Radio in his car,The radio in question was a 2 meter ham radio mobile that would not go out of band, the person told the officer that he was a Ham Radio Operator and showed him his license,The officer was told by a Communications Supervisor that "The radio is not a Police scanner" it is a Ham 2 meter radio, After hearing this from the Communications Supervisor on his radio, the officer returned to the car he had stopped and he told the person he had not ever so him again in the area or his radio would be taken from him and he would go to jail. The new officers that are just comming out of road school or ILEA do not care, all they want to do is chase red lights and pull over people who have more than one antenna on the car,Example Carmel Police pulling over a unmarked Indiana State Police Trooper who had many antennas on his car,How many Carmel Police Officers did it take to do this,5 of them !!! My point is this, ALWAYS CARRY A COPY OF 35-44-3-12 with you and if you are stopped by a Officer show him your copy of the law,It is available to the public thru the public library under Indiana Law, go to Title 35 and look for 35-44-3-12.Trying to keep everyone out of trouble!!!!!! I am not a legal person but being a former Law Enforcement Officer this is the way the law reads,Sorry to bump heads with everyone but this is my view on this subject at hand.....Thank You,Tim DeLong W9NES Ham Radio Operator,Indianapolis,Indiana
