Admittedly 30 years ago, but I was busted and the scanner confiscated
from my car. I wasn't a Ham yet. 16, I had a record, and my scanner was in
the Marion County Sheriff's Property Room. Had to petition the Juvenile Court
when I was 21 to have my record expunged. Navy looked cross eyed at me for it
(I required a Special Background Investigation that most Ensigns don't
need/get).
Second time, a Campus cop staked out my car and waited for me to
return to it (in the loading/fire lane with flashers on). When I did, he strolled
up and tapped on my window to roll it down. With his light first in my eyes,
then on the scanner (Regency Touch 16 I had been a Line Tech on), he said "You
know, that's illegal." A statement, not a question. I asked him if he knew
the law, which he said he did. I showed him my Ham license, reminded
(informed?) him of the exemption, rolled up my window, and made a hasty departure
while he thought about it. I had no intention of loosing the radio, or spending
the time trying to get it back.
New Kentucky law recently reported in Monitoring Times (by a local
Indianapolis attorney no less) is even more 'permissive' for the Officer to
confiscate it on the scene. No mention of exemptions for a Ham license.
I wish it wasn't an issue, but it is. A Ham license plate usually
answers the question for the cop before they pull you over "for having and
inordinate number of antennas on the car" (Carmel, IN PD reason given for pulling
over a State PD unmarked car!)

Unfortunately, civil disobedience is all we have left. I'll scan in my car
like it or not. Been doing it for 20+ years. Ticket is just a Class A mis
anyway so you'd probably get nothing but probation unless you were robbing a
bank or car jacking.
"Crime" created by the stroke of a pen..... how wonderful.
Remember when legislatures had real criminals to deal with?
You can also get a note from your mom..... errr local lawman if one is that
scared.
