That could be.  But it seems likely that they simply don't care, or think
that the rules don't apply.

I beg to differ.  The actions of those that have operated illegally is
about half as bad as those that willingly allow it to happen.  The level
of arrogance and ignoracnce that these people have demonstrated, both in
general courtesy and RF theory is simply mind-boggling to me.  Where is
their supervision?  Even worse, where is their common sense?  They have
dozens of frequencies for use LEGALLY for simplex.  In fact, I would
hazard to guess that if you looked up all of the pre-MECA law enforcement
licenses, over half were still in force.  Heck, KSA318 was renewed a year
ago!  That offers AT LEAST 20 frequencies one could legally (or
quasi-legally) use with guaranteed little or no interference to legitimate
users.    For the record, I don't get irratated one bit at the fact that
they are using unlicensed frequencies for informal conversations.  What
concerns me is their lack of appreciation for other users.  Users that
have every right to be there.

I really don't understand this at all.  Do I appreciate the hundreds of
police that are out busting their butts to protect us?  You betcha.  Does
my heart skip a beat whenever I hear an officer in trouble on my scanner? 
Absolutely.  But they are not exempt from the laes that they enforce. 
Regardless of who they are, or what they are doing.

If you want examples of legal police simplex, try listening to Johnson
County.  As far as I can tell, our officers accomplish the same thing -
they have quite a few channels to chit-chat on - only all of them are
legal.  Either through MOU's or actual licenses.

Just my opinion, take it or leave it.
