Well, I may as well add my 2 cents worth, although  it won't mean much.

Several years ago, I had a scanner taken from me and cited for scanner
possession in a car. It was a four channel and had fire and ems freq. in it.
The Sheriff himself did it along with a couple others...he said "We keyed
our mike and your scanner stopped. That's all we needed to know."
This comment was made after explaining it had no cop channels...... trying
to explain what intermod and adjacent channel overload is was of no use at
2am when you are fishing and they are examining your car....
I went to an attorney who told me I had no case and I should just pay
because the ticket would be about $75 and his fees would be $200 or
more.....I paid the fine...
I was told by a reliable source that was in the "know" that my scanner was
sold at a flea market in KY along with many many other items encountered by
such methods...

End of story....  not many around here know it, I'd guess the secret sales
helped that!

My only criminal arrest of my life....

I later went on to work at that Sheriff's Dept and now I am at a city Police
Dept...
I still have scanners in the car.... but they have cop channels.....
