This is a hot topic! We all must take a breath
here and look at the big picture. Gary said: "A
cop is supposed to set the example....." That is
a very true statement. It is one taught in the
various police academyes around the country. If
one has the attitude that we should look the
other way if the police use frequencies not
assigned to them creates a dangerous situation
for all. Take the extreme example of the police
shooting in New York City a couple years ago in
which three cops (plain clothes) emptied their
automatic weapons into an innocent person because
he hesitated when the cops shouted at him. Police
can commit abuse just as the civilian. But their
slogan; to protect and serve steps the police up
to a higher standard. If police are allowed to
use non assigned frequencies with impunity then
the people who were charged and convicted of
taping the past Speaker of the House, Newet
Gingrich, while he was on a cell phone.

Now then having said all that lets look at the
frequencies in question. After some thought and
looking up some FCC rules and regs on this
subject I have come to the conclusion that maybe,
just maybe, the city and county involved in this
issue just may hold a FCC license in each of the
bands. If that is the case than anybody working
for the city/county/state may indeed use the
frequiences in question at their pleasure. An
example: When the then candidate for president of
the US, Ron Ragan, was in Kokomo, Indiana the FCC
frequencies assigned to Delco Electronics GM, now
Delco Delphi, were used in direct support of the
agents with Ragan.

So maybe the subject should be dropped unless the
orginial author has checked into how many FCC
license the city/county has in their "authorized"
