Woman pleads guilty to drunken driving, listening to scanner

A Bay City woman accused of drunkenly driving with a baby in search of drugs, all while listening to a police scanner on her phone, has pleaded guilty to two felonies. However, she has the chance to avoid having them stay on her record.
Olivia M. Rose, 25, appeared before Bay County Chief District Judge Dawn A. Klida on Tuesday and pleaded guilty to single counts of operating a motor vehicle while intoxicated, third offense, and using a police scanner in the commission of a felony. The charges are five- and two-year felonies, respectively.
In exchange for her pleas, the prosecution agreed to dismiss counts of driving while license suspended, denied or revoked, and having an open intoxicant in a motor vehicle.
Klida sentenced Rose to Probate Court's Family Treatment Court for 20 months. If she completes that program, she will be allowed to withdraw her pleas and instead plead guilty to operating while intoxicated with an occupant younger than 16 and attempted use of a police radio receiver.
According to court records, police at 11:33 p.m. Nov. 5 responded to the area of 11th Street and North Monroe Avenue on a suspicious vehicle complaint. The person who called Bay County Central Dispatch reported a woman was driving in a car, stopping to ask passersby if she could buy pills, court records show.
Police located the suspected vehicle -- a blue Toyota Camry with an allegedly defective taillight -- and pulled it over on Saginaw Street near Columbus Avenue. Rose, the driver, provided police with an identification card but told them her license was suspended, court records show.
Also in the car was a male baby, about 1 year old, court records show.
Police noticed an open pint of vodka on the floorboard of the Toyota as well, court records show.
Rose also had a cassette adapter connected to her cellphone, which had a police scanner app playing through the car's stereo, court records show.
Rose told the officers she had just gotten off work and was driving to her sister's house. She denied the allegation that she was out looking for pills, court records show.
Police wrote in their reports, contained in court records, that Rose did not emit an odor of alcohol, but her eyes were watery, bloodshot and glassy and her speech was slurred.
She submitted to a preliminary Breathalyzer test, which indicated her blood alcohol level was at 0.17, court records show.
In Michigan, a person is legally intoxicated when his or her blood alcohol level is at 0.08, court records show.
Police arrested Rose.
