Oh boy, here we go...
Yes, FAA is "trying" to do something, but is it enforceable??? This is why photographer Raphael Pirker flying his drone in 2011 beat his case, actually fine earlier this year. The NTSB Administrative Law Judge found the FAA rule overreaching (my word). The judge himself stated that by the FAA's interpretation, the regulations would apply to anyone flying a paper or toy balsa plane. I'm not saying that the FAA was wrong per se, but only pointing out that the precedence has been set until the FAA can come up with a better rule.
