Good afternoon,
Our MCVFRA team, led by our general counsel John Bentivoglio and Skadden Arps has just returned from Maryland’s highest court – the Court of Appeals in Annapolis. This morning at 10a, John argued on the MCVFRAs behalf to reverse the decision of the Circuit Court dismissing our lawsuit. The Court of Appeals justices (7 of them) heard our case with 30 minutes for each side. There were MANY questions from the bench and John did an amazing job articulating the reasons as to why the board of elections was wrong in its determination on the signatures.
This appeal process usually can take 2-4 YEARS to reach where we have in just under 3 weeks.
We have just received notification that the Maryland Court of Appeals has REVERSED the decision of the Circuit Court and has ORDERED that the ambulance fee referendum be placed on the November ballot! In short a complete victory for the MCVFRA, our legal team, and the citizens of Montgomery County and the State!
We want to thank John Bentivoglio and our entire team at Skadden Arps. They have put thousands of collective hours into this case. Their unbelievable legal minds have pulled out an incredible win in such an unbelievably short timeframe.
We are working on a press release right now and will have more out to you shortly.
Thanks!!
Marcine and Eric
