I wonder if Mass, like Maryland, is a two party consent state (you must have
consent from both parties involved to legally record a conversation, as I
understand it). Given the basis for this article, I would guess that it is.

According to the article, it hinges on whether the recording is done in
secret or not. The law they are trying to enforce is the law that prohibits
recording a two-way exchange when one of the parties is not aware of the
recording. It was originally written to cover audio recordings of telephone
calls, and the police are extending it to include recording them in action.
