Interestingly enough, this issue has been bounced around before:

That was back in 2008.
Why doesn't the ARRL petition the FCC to just amend the rules to allow for
encrypted traffic under 97 if required?
If H&W messages can be passed encrypted, why is that so terrible? In fact,
wouldn't every institution if given a choice rather have this communication
encrypted?
