The problem is - they can't.

The FCC can only do what is allowed by international treaty. Anything 
that radiates past our boarders is covered in this way. In order to 
re-allocate in the fashion the article describes you would at least 
have to get Canada and Mexico to go along with the idea. Good luck on 
that.

This also places a limit on what they can do with  BPL as well. If the 
system in Buffalo or Detroit messes up stuff north of the boarder a FCC 
ruling that it's ok won't help at all. Of course if the Canadians go 
along with the BPL idea then that's not going to matter ...
