I think this validates our discussion a few weeks back that the
contract for shipping and insurance coverage is between the "SHIPPER" and
the shipping company. Bill you never had a chance in this case...you were
at the mercy of the shipper...being Rick. A stand up guy would make things
right by his customer....Until that radio (or a refund) was delivered to you
in the shape you paid for.....the deal was not done. Of course a lot of
this is hindsight.
I can remember 15 or 20 years ago it was not uncommon to open a package and
check for suspected damage and refuse the delivery if there was. I'm not
sure how that would fly today!
I have never met or done business with Rick...but I would hope this is not
the norm for how he does business..... He should not have recommended any
action by you, outside reporting the damage, with the shipping company
because he knows very well that the contract is between he and the shipping
company!
I shipped an R1051 to a customer a few weeks ago and physically the radio
arrived without a scratch. But the RF deck had taken a shot somewhere along
the line. As soon as the turret assembly tried to spin several of the
contacts were folded. Needless to say the radio didn't work and the
customer was dissapointed after waiting on a list for a few months and
paying several hundred dollars for the item, much as Bill did I'm sure. The
customer was very nice about the whole thing which made a difficult
situation much easier. The box was not damaged at all...best we can figure
it was dropped flat on it's bottom or top from a significant height. The
radio was surrounded by 3 inches of high density foam insulating board on
all sides and could not move within the box. A claim would have been a
waste of time with any shipper in this case because there was no physical
damage.
The customers radio was repaired promptly and at no additional cost to him.
The deal is done....the customer got what he paid good money for!
I'm convinced Rick should have done the same! Certainly any money recovered
from the shipping company should have come to you if you opted to keep the
damaged (and devalued) radio! Rick should not have profited from the
situation!
