Our lawyers and regulators, if they have addressed your insightful 
question, probably have classified BPL as an "additional service" akin 
to caller ID. By alluding to grid monitoring and control, meter reading 
etc, it's  "technological progress" (in the minds of those who profit 
from it).

Unless one can demonstrate harm or damages in court, it's unlikely that 
one can get an injunction against it. Even now, I believe you can ask 
the direct marketing association to remove your name from many mailing 
lists, but you cannot force them to do so; they believe it is a 
courtesy. Not like the "do not call" lists for another scourge.

My sense is that concerned parties might raise the issue of potential 
misuse as well as the possible and unknown health hazards of unregulated 
broadband emission. I also believe that, as has been pointed out by 
many, the economic outlook for BPL is not very good.
