theoretically lapse and
pass out of existence, along with the HA."

While that may or may not be true for the homeowners association, covenants
run with the land and generally remain enforceable.  As to who can enforce
those covenants and ways to overcome a covenant, that is specific to each
situation and is best handled by an attorney.
