Just out of curiousity, was the Ham's radio modified
to use the police frequency or did he use the actual
police radio?  This is not clear or I missed it.

I have heard hams in the area modifying their [ham]
rigs to talk on CB because in their perception this is
legal because they are a ham and can use higher power.


As I recall you get into what the rig was orginally
certified to do.  By making this modification to talk
on CB or police bands your tampering with the radio
may be the initial problem.   

Add to this the fact your on an emergancy band and
with all the means of communication available to you
today it is hard to justify.

There was a case in CA a few years ago where a ham
used 'his modified' rig because he was injured to call
the police and if I remember right he got fined.  I do
not remember the particulars.  

Shoot why not just contact someone on Ham band and
they can make a phone call to 911 or what ever service
is appropriate?  The 14.300 MM net, 7.248, 7.251,
7.255, 7.258 are also travel type nets and you can
always find someone.
