All you specialists in firearms, please stop!
The Sauer 38H pistol probably qualifies as a C&R firearm under current BATFE
regulations.
Depending upon the state in which the firearm is located, one need not sell
the firearm through a licensed dealer, to a resident of that same state.
There is no Federal restriction on the transfer of a firearm between two
individuals of the SAME STATE.
To sell a handgun outside one's state of residence, the firearm must be
shipped to a licensed dealer in the purchaser's state, it is then that FFL's
responsibility to ensure compliance with applicable state and/or local
ordinances and regulations.
Whether or not a firearm is on the C&R list, the transfer if not within the
state of residence of both parties, must be in accord of the GCA 1968 as
amended. C&R firearms may be transferred interstate to another C & R
licensed individual, who may only purchase C & R firearms for personal
collection, not for RESALE.
