The current issue of Railfan and Railroad has an editorial on this
very issue, as it pertains to photography of railroads.

But the writer has an interesting observation on this, though, that in
general, the railfan audience is quite knowledgeable about
railroad operations and activities, and presents an opportunity
to be an extra set of eyes for the railroad, both in terms of
security of rail facilities and safety of moving equipment.

But as for your thought on permission vs forgiveness, I always thought
it was the opposite.  Easier to get forgiveness than permission.

But I do agree with you, it is a different day and time.
