Tom,

I think you are mixing some issues here. Your comments about power would 
better describe operation in the 160-190 kHz band (1750m) under Part 15. 
Operation in the 137 kHz range in the last 11-12 years in the U.S. has 
been under Part 5, in the Experimental Service. ERP's of one watt or 
greater have been very common, produced by transmitters with hundreds or 
even thousands of watts. If you file any comments with the FCC, you 
should be careful to not to mix the two "services."
