It depends on the jurisdiction and who is doing it. Over here both would be
illegal for the private individual (unless you are snooping your own
cordless phone - but you would then run the risk of promoting the opposite
of domestic tranquillity).

However, in a court case here some years ago, evidence gathered by the
police through listening in on a cordless phone was admitted even though
they did not have a warrant. If they had been listening to any form of
public telephone network they would have required a warrant to do so and for
the evidence to be admissible, but the court ruled that the link from the
cordless handset to its base station was not part of any "public telephone
network" and, as the law stood, the police were allowed to do what they were
doing.
