I agree, today.  As soon as optical broadcasting is demonstrated to be 
practical - perhaps by amateurs with overpower license-free 
scratch-built systems - and there is money to be made, the laws will 
suddenly impose themselves upon the spectrum.  ASCAP, BMI and SESAC will 
be at the door, too, demanding royalties for public performances.  
Profit will change the rules, and "fairness" will prevail.  Ahem.
