Yes you are right, as the scattering does not mean absorption of 
energy. However, one will find that only the light that fits the angle 
will reach to the destination and is also dependent on the size of the 
particle distribution, which will change in time. LIDAR technology 
works fine and hence one can communicate as well. Perhaps a broad 
transmit band and optimized scanned receiver band will be the best idea 
but an expansive one. You can place some more light if you have 
someuseful experience in LIDAR as most of the people in discussion want 
their data to reach the destination and will not mind about whatever 
Physics law helps them.

I am very happy to see you writing in this Physics like discussion.
