     Programs like ARGO have been used to transmit signals using very low 
transmit powers or by very high loss paths (EME etc) for some time now. 
Here is a link where an example is given of a DX contact with 100 
microwatts on the 13.56 MHZ ISM band. I think they are operating under PART 
15 rules just as the RFID tags and such. I am not sure why they did not use 
20 meters unless they did not have HF privileges. Remember, if you don't 
have privilege to operate on a band you can't do it at any power level, no 
matter how low of power you wish to transmit.

This ISM band is being used by non hams for communication as well.
