I'm guessing the third question was to help nail down the origin of the
mod, especially if the answer to the second was "I dunno."  It seems to me
it's easier to demonstrate intent to break the regulations if 1) the rig
was purchased with the mod, and the buyer knew about it; or 2) the buyer
did the mod himself.  If the mod was there and he didn't know, he could
have "accidently" transmitted outside the band.

Also, if someone is selling modded radios as such that might be
interesting for future enforcement action.

As far as selling a piece of equipment to someone without a license,
refusing to do so could be considered part of the "self-policing" aspect
of ham radio.
