On July 14, 2010, a FCC Report and Order was adopted and issued amending
the amateur radio to permit amateur radio operators to transmit messages,
under certain limited circumstances, during either government-sponsored or
non-government sponsored emergency and disaster preparedness drills,
regardless of whether the operators are employees of entities participating in the
drill.
Per FCC: Although public safety land mobile radio systems are the primary
means of radio-based communications for emergency responders, experience
has shown that amateur radio has played an important role in preparation for,
during, and in the aftermath of, natural and man-made emergencies and
disasters.
The bottom line here is that employees who are licensed amateur radio
operators can use their employer's equipment within the confines of the new
rule. It appears that for governmental employers there are no restrictions,
however for non- governmental agencies there are some. Those limitations are,
one hour a week for testing and up to twice a year for non- government
sponsored exercises that don't exceed 72 hours. It seems implicit that if it's
a government sponsored event or your operators are volunteers then these
limitations do not apply.
It does not define "testing" so any use of the radio(s) could be a
considered a test of the equipment. Although this is not a perfect solution is
does set forth an acknowledgement of the need for employees of emergency
response agencies, including privately held organizations such as hospitals, to
have the ability to utilize amateur radio during emergent situations and
that testing and training for those events are a critical element in the
success of the effort.

remind you that these "time of use" limitations below only apply if you
are employed by the entity that owns the radio equipment and the
test/exercise/training is non-governmental in nature. Thanks go to a large number of
