I agree w/you 100% Don, this poor guy got caught between the gears because of the wording of the regulation.
The gal at the fcc doesn't care about why it happened, all she is concerned w/is that it did happened.
To her, it is all black & white. She isn't giving the guy any slack what-so-ever.
Those of us who are in EmCom should pay particular attention to this situation because we may wind up in this same or similiar situation.
The wording of the regulation should be changed to allow hams who work for agencies/orgs that host ham radio stations for emcom, to provide coms for the agency/org, as if they were volunteers & didn't work for the agency/org.
I could see her point if Jeff worked for an autodealership or a hardware store & was soliciting for customers on ham radio. That would clearly be in violation of the rules. If I heard something like that, I would want to report it to the fcc myself.
But if I heard something like what Jeff did on ham radio & knew for a fact that he was an employee of the angency/org who hosted the ham station, I would not report it to the fcc, but actualy encourage this activity because it is for the good of the public & in public service.
This impacts agencies/orgs like police departments, fire departments, American Red Cross, ect, not just hospitals.
There are several names/terms for people like her & I will leave it up to the readers to figure out what those names/terms are.
