It's widely known, and that's all that's necessary.
The intent of that provision is to prevent ham radio from being used for spying. I know that sounds corny today, but you can bet that in 1934, it sure didn't.
You aren't allowed to encrypt your messages, but you are allowed to send them in a zip file. Difference being the zip file format is published, and there's no intent to conceal. Encryption isn't published (at least not the key) and the intent is to conceal.
If we read it the way you suggest, then we certainly couldn't use the word "is"... :)
