Requiring a license won't work because it's already been tried and defeated 
in court. Check out the State of California vs. Richard Beresford Cooper, 
Raymond Bryant, Martin Hertz et al D.B.A. Communications Attorney Service on 
Westlaw.

The court ruled in this case that it would be "restraint of trade" to 
require a license to purchase a ham radio. The court equated purchasing a 
ham radio with a hobby that did not warrant protective measures such as 
guns, tabacco or alchohol.

What did we learn from this? First that the legal use of a ham radio is the 
responsibility of the end user not the dealer. Second that in the courts the 
end user will be looked upon as a hobbiest not a murderer or a drug 
dealer.73

Nope. What they did is perfectly legal. Read his description. Maybe he
just isn't an active ham. As long he doesn't transmit, he's fine.
