Gentlemen,
It not illegal to have modified or home made amateur radio equipment.
There is no certification required for amateur service like there is for
CB and other commercial radio equipment. That is why it is Illegal to
have a modified CB radio. It is also illegal to use amateur radio
equipment on commercial bands. As soon as the 60M band is authorized we
can use our modified equipment with no problem.

It depends on the context. A CB'er (non-Amateur) who simply possesses
the
ability to transmit more than 5 watts on CB frequencies is considered
guilty. An Amateur who posses the ability to transmit on non-amateur
frequencies is not.
The one consistency in the FCC rules is their inconsistency.
