First:
The Constitution was written by one fella, and he made a few
mistakes, which is why the first 10 Amendments had to be added
before it would be accepted. It can be argued that some of
the Amendments he wrote were also flawed, particularly the
second Amendment. It's badly worded. So is Article 1 Section
8. There was significant criticism of that wording, and Madison
insisted that no one could misinterpret the meaning, given
that the list immediately followed. However, that is exactly
what Congress has done.
Second:
There was quite a bit of debate about both Copyright and Patent
at the time, with Benjamin Franklin (for one) being adamantly
opposed to both.
So, don't take the existence (or non existence) of anything in
the Constitution as being indicative that the FF were in agreement
about whether it should be there.
Incidentally, the 2/3 compromise is also part of the orginal
Consitution. Do you agree that we should have kept that as well?
Just food for thought.
The laws are what they are. I've go no beef with enforcing
laws as they are. That doesn't mean that I have to agree with
the law, or support its continued existence.
Copyright was created by the Queen of England, to ensure that
