There were many posts to the reflectors recently regarding this issue and
the greatest consensus is that the new owner does have the right to do what
he is doing. Anyone that wants to challenge him is free to do so and then we
will know with certainty. I do think that anybody looking for Heathkit
documentation need only post their needs on one of the Heath reflectors and
they probably will obtain what they need in some fashion
.
Just an fyi, Heath has only been "out of that business" since 1992 or so,
not over 30 years, and still exists offering educational products and
materials.

d8pro.com does apparently plan on selling their manuals or copies and/or
licensing others to do so. It has been noted that they have offered to allow
BAMA to post schematics only but the moderator for that site has not decided
if he can or wants to handle that transition.
