Greetings!
N1RL has been otherwise occupied with holiday company, but third-party
is not an issue for the FCC provided that it's not a problem for the
country on the other end. As Steve notes, the FCC's position is pretty
much the same Industry Canada's. We included a note about third-party
traffic in a couple of the stories on our Web site. Changes regarding
third-party traffic for emergency traffic were made at WRC-03, but the
FCC has not yet formally adopted these.
That said, they're asking that folks refrain from sending incoming H&W
inquiries into affected regions. It's overloading the system, so to
speak. We also had something about that on our Web site.

I'm surprised that N1RL hasn't answered, let me give a try.
I'm not sure about the FCC's position, but "Industry Canada" (Canadian
equiv to FCC)
has said "Canada has no objections to its licensed radio amateurs
passing
international communications on behalf of third parties in support of an
emergency or disaster relief in the countries affected by the recent
tsunami and earthquake, provided that the affected country allows its
radio amateurs to carry on such a communication" (See full quote below)
In addition, the US position has historically been that the US does not
object to
such 3rd party communications as long as the government on the other
party to
the 3rd party communications doesn't object.
So, in this case if there is no formal 3rd party agreement between the
US
and the
other government involved, but the other government allows their hams to
communicate
this type of 3rd party message, then I'd probably

disaster areas
Canada has no objections to its licensed radio amateurs passing
international communications on behalf of third parties in support of an
emergency or disaster relief in the countries affected by the recent
tsunami and earthquake, provided that the affected country allows its
radio amateurs to carry on such a communication.
This is in keeping with the recent "FINAL ACTS WRC-03 WORLD
RADIOCOMMUNICATION CONFERENCE (GENEVA, 2003)" where
paragraph 25.3 (2) states that "Amateur stations may be used for
transmitting international communications on behalf of third parties
only in case of emergencies or disaster relief. An administration may
determine the applicability of this provision to amateur stations under
its jurisdiction."
Under normal circumstances, Canadian radio amateurs must respect
the third-party agreements and arrangements noted in Industry
Canada's Radiocommunication Information Circular RIC-3 - Issue 2,
dated April 2002. Canada has concluded agreements or arrangements
with the following countries to permit the transmission and reception of
international communications by Canadian amateurs on behalf of third
parties: Antigua and Barbuda, Australia, Bolivia, Chile, Colombia,
Costa Rica, Dominica, Dominican Republic, El Salvador, Grenada,
Guatemala, Guyana, Haiti, Honduras, Israel, Jamaica, Mexico,
Nicaragua, Paraguay, Peru, Saint Vincent and the Grenadines,
Trinidad and Tobago, United States of America, Uruguay, and
Venezuela. Under normal circumstances radio amateurs in
Canada are obliged to respect these agreements.
