Texas buyers still owe USE TAX on items purchased out of state even if
they don't owe
sales tax. If HRO moves to DFW all of their sales will be taxable no
matter where shipped from. As Virgil points out the sales tax money is
what pays to keep the state running maybe you would rather have a state
income tax.
All sales in Texas are subject to sales tax unless you have a resale
certificate on file
from a buyer, signed and with their Texas tax number and a list if items
covered by the cert. Just having a number is not enough, I learned the
hard way, from the comptrollers office. I had to pay $7000 and the state
auditor went to my customer and collected another time for the same amount.
Hamfest season is coming up I am sure I will have to deal with many hams
who think used items should not be taxed, but they are wrong.
