[Hammarlund] Fwd: Hammarlund Rights

Ken,
I do not know where your information comes from, but I do not think it is
totally accurate. I am a published author and also have several software
programs that were previously sold nationally, they bear a registered trademark.
As long as I own the rights to it, it is not free for the taking! The primary
reason people are getting away with copying and selling these manuals is because
the companies no longer exist or it is not worth their while to litigate.
Winning is one thing, collecting is quite another!
The "Hallicrafters" name is still legally owned, but said owner has no rights to
anything but the name. Not the products, not the manuals, not a thing. He can
put the name on anything he so desires, provided he is the legal manufacturer of
it.
ken there are a lot of gray areas here and I would caution you, or anyone else,
to be extremely careful thinking that one thing or another is now fair game for
he/she to reproduce and sell. They may get a surprise that could economically
destroy them.
It also becomes gray as to what can be copied and given away, as BAMA does, and
what can be copied and sold.
i would encourage anyone to discuss this with an attorney who specializes in
these areas before they unknowingly step off the cliff of how to make an easy
buck and live to regret it.

Duane, you are correct. To obtain the rights (copyright, trademark, etc.)
is a complex legal matter. I think some of us are referring to publishing
manuals (either on the internet or hardcopy) that are in the public domain.
Anything published before 1989 and not carrying a copyright mark was in the
public domain immediately upon publication (with a few exceptions). This is
how BAMA and others who publish these early manuals are able to carry on
business.

Ken
