[Ham-Mac] Trash won't delete some files

I have some files in the trash that won't delete. One of them is a 
single empty folder, one of them is  a nested (four levels) folder, 
with the innermost folder empty, and the other two are two copies of 
the same text file that I am told are in use and can't be deleted. 
All the files come from attempting to delete the backup of my main HD 
from the second HD. The two folders are the top level (root?) folders.

I have gone the usual route of seeing that they are unlocked, I have 
permissions to read/write and so forth. I am open to any and all 
suggestions.

I am running 10.4.6 on a G4.
