It is illegal to access any network, wired or wireless, without permission.
The grey area here is if there is implied permission, and I'd bet the fine
print says paying customers have permission, but it should be up to the
coffee shop owners to decide if prosecution is warranted, not a prosecutor
driven by a law like this!

Now here is a scary story - both of the failure of
a police officer and a prosecutor to exercise their
responsibility to exercise reasonable discretion and
the less-than-wise legislators in writing such sloppy
law.

In any case it suggests that we need to know the local
laws and regs before accessing what appear to be "open"
or "public" Wi-Fi networks.
